1. DACA.

Two weeks ago, the Supreme Court agreed to review the DACA program. Specifically, they agreed to decide whether the Trump Administration’s decision to end DACA could be reviewed by a court and whether the decision to end DACA was lawful. This means that the case will probably be argued in the November-December time frame of this year and decided several months thereafter. Keep in mind that the Trump Administration is going to argue to the court that President Obama exceeded his authority in starting DACA in the first place. If you have DACA now, you can still renew for a 2-year period.

2. Immigration Enforcement.

President Trump has said that immigration raids will begin after the 4th of July. Today we are 6 days out from the 4th of July. I think the most likely targets are immigrants from Honduras, El Salvador, and Guatemala who have received deportation orders in the last two years. The next most likely targets are immigrants with deportation orders who have not left the U.S. There are approximately 1 million people in this category. There has not been a concerted effort by ICE to target people with deportation orders for several years. So, we are overdue, and the Eagle Valley and Roaring Fork Valley is overdue. Recently, I talked about the importance of not letting ICE agents into your house. Remember, the only legal way they can get into your house is if you or family member let them it.

I also think ICE may want to round up family members who do not have orders of deportation. They will ask you for ID and ask if you are legal. Remember, you do not have to say anything to ICE. Don’t give ICE any documents. Tell ICE you want to remain silent and do not wish to talk to them.

3. Parole in Place (“PIP”).

There were rumors out of Washington last week that the Trump Administration was going to cancel the “parole in place” or PIP program for spouses and parents of members of the military. If you have applied for or are thinking about applying for PIP, you should consult an immigration attorney right away. One thing you may want to do is get your application in quickly.
